minutiae LLC is committed to ensuring that your privacy is protected. This Privacy Policy explains how we use the information we collect about you and the procedures we have in place to safeguard your privacy.
In this Privacy Policy references to we, us, and our are to minutiae LLC. Certain expressions used in this Privacy Policy (such as Images) have definitions which are set out in the Terms and Conditions for use of minutiae.
1. What Information we Collect
The information we collect may include:
1.1 Personal details you give us when creating your account, including your email address and hash functions of the email addresses of your contacts.
1.2 Your device information so that we can send, push or update notifications from minutiae (can be disabled in device settings).
1.3 Prompt for GPS signal so that we can determine your location and store GPS coordinates on our server.
2. What we do with your Information
2.1 Any personal information we hold we may use for some or all of the following purposes:
2.1.1 To create your account and provide you with the features of minutiae.
2.1.2 We may use your email address to send you information on other products and services. You will be offered the option to opt-out.
2.1.3 We promise not to share your personal information with any third party.
2.1.4 We may use aggregated information for the purpose of monitoring the use of the minutiae Application. Such aggregated information may be provided to third parties. These statistics will not include information that can be used to identify any individual.
2.2 Please note Images that you post on minutiae become available to be viewed by another minutiae user randomly selected. Such other user is not given details of your identity. However, your GPS location will be sent to other minutiae users receiving images from you, but these will locate your position to the level of country and city only.
3. Protection of Information
3.1 Applications are not a secure medium. However, we have put in place recommended up-to-date data security measures and will review these and keep them updated regularly.
3.2 Subject to the terms of this Privacy Policy, we keep your information confidential. To ensure that we are able to maintain confidentiality, you must comply with the Terms and Conditions for the use of minutiae.
3.3 You agree not to collect any personal information on individuals by your access to minutiae and Images sent to you by others.
4. Updating/Modification
4.1 If any of the details you have provided to us change, please give us the correct details by email to info@minutiae-app.org
4.2 We reserve the right to change this Privacy Policy without notice. You are advised to check this Privacy Policy regularly as your continued use of minutiae will be considered acceptance of it.
5. Your Consent
5.1 By setting up your account and submitting your Images to minutiae you consent to the use of that information and content as set out in this Privacy Policy.
5.2 Owing to the global nature of the internet, the information you provide may be transferred to companies outside the European Economic Area (EEA) that do not have similar protections in place to those which apply in the EEA regarding your data and its use as set out in this Policy. However, we have taken steps outlined in this Policy to protect the security of your information and will keep any transfers outside the EEA to a necessary minimum. By submitting your information, you consent to these transfers.
6. Data Subject Requests
6.1 We are the Data Controller in respect of personal data submitted by you in respect of minutiae for the purposes of the Data Protection Act 1998.

6.3 This Privacy Policy is subject to the Terms and Conditions for the use of minutiae.
Terms and Conditions for use of minutiae Application
In these Terms, we, our or us refers to minutiae LLC the creators and operators of minutiae. Full details of our identity and address are set out in term 16.
A minutiae is an image taken by you and shared anonymously with another user of minutiae completely at random.
1. Acceptance of Terms/User Restrictions
1.1 By accessing minutiae you agree to be bound by these Terms and accept our Privacy Policy. If you do not accept these terms, you should not use the services offered by minutiae.
1.2 You agree that you will not use minutiae for any illegal purpose or in any way that may impair the performance, corrupt the content or otherwise reduce the functionality of minutiae. You also agree not to attempt to compromise the security of minutiae or attempt to gain access to secured areas or sensitive information.
1.3 These Terms apply to all users of minutiae who will contribute images (photographs taken by the user). The terms also apply to recipients of images. minutiae is not linked to other applications and does not provide a means for users to interact with each other.
1.4 minutiae is only available to individuals who are aged 18 years or more or aged between 14 years and 18 years and who are authorized to access minutiae by a parent or legal guardian. If you are a parent or legal guardian who has authorized a young person to access minutiae you are responsible for his or her online conduct and for the consequences of any misuse of minutiae.
2. Modification
2.1 We reserve the right to change these Terms without notice. The new Terms will be available on minutiae, and your continued use of minutiae will be considered acceptance of them. You are advised to check these Terms regularly.
2.2 We may at any time modify or remove any part of or any content from minutiae without warning or incurring liability as a result of such action.
3. Access to minutiae
3.1 To access minutiae you need to provide a unique password and email address for verification. You will also be prompted by minutiae to access your GPS coordinates so your location can be recorded.
3.2 You are responsible for maintaining the confidentiality of your account, user name, and password and for preventing unauthorized access to your account. You accept responsibility for all activities that occur under your account or username and password and will take all necessary steps to keep your username and password confidential and secure. You must inform us immediately if you believe your username and password have become known to another or are being used in an unauthorized manner.
3.3 You must ensure that the details you provide to us are correct and complete, and you must tell us immediately of any changes.
3.4 We reserve the right to remove material from minutiae, refuse access to minutiae, and in appropriate circumstances to terminate your account. You may be liable for our losses and the losses of third parties due to unauthorized use of your account.
4. Content
4.1 minutiae permits you to upload photographs (Images) to its host server. This permission is strictly subject to your compliance with these Terms.
4.2 You alone are responsible for your own Images and for the consequences of uploading Images on minutiae. By uploading images you confirm:
4.2.1 You have permission to use all such Images. You must yourself create the image (snap the photo).
4.3 You retain ownership rights in Images which you have created. You also grant to all other authorized users of minutiae a non-exclusive license to have access to your images through minutiae and to view your Images as permitted through the functionality of minutiae.
4.4 “Use” for the purpose of these Terms in relation to Images means and includes use, reproduction, distribution, display, and preparation of derivative works.
4.5 In relation to your images you confirm that you will not:
4.5.1 Submit Images which are defamatory, threatening or likely to harass, racially or ethnically offensive, pornographic, obscene or which might encourage violent or criminal conduct or which are otherwise inappropriate.
4.6 Be warned that as a User of minutiae you may encounter Images that some people may find shocking or offensive. We do not endorse or approve images, but we will not in all circumstances, moderate them. However, we reserve the right to remove Images without explanation and without notice.
4.7 We are not responsible for the taste, decency, or accuracy of any Images. You agree that you have no claims or remedies against us in relation to any inaccuracy or offense caused by any Images uploaded to minutiae.
5. Your Use of minutiae
5.1 When you send an Image via minutiae it is uploaded to our servers and shared anonymously with another minutiae user at random.
5.2 You may receive Images from other anonymous minutiae users at random. Images are not exchanged. You will only receive Images when you have sent Images yourself.
5.3 minutiae Images are stored on our servers, and each minutiae Image is referenced as a unique public URL. These public URLs are not publically searchable, indexed, or published by us. Each image is sent only once to one other minutiae user.
5.4 We will tell the recipient of your Image your geographical position by GPS but only down to the level of country and city or town. Your actual GPS location will not be revealed to any other user of minutiae, whether you are the sender or recipient. A landscape view of minutiae can show you where Images have been sent to and where they have been despatched from.
5.5 If you flag an Image you receive as inappropriate, it may be removed and deleted from your timeline view in addition to our servers.
5.6 If we suspect a minutiae user has captured inappropriate content on a number of occasions, we may choose to block the sending user’s account at our own discretion.
6. Liability
6.1 We will not be liable to you for any direct, indirect, special, or consequential damages, including loss of business, revenue, profits, data, or anticipated savings in relation to your use of minutiae or any other loss.
6.2 Specifically, we shall not be liable to you for any images or for any defamatory, offensive, or illegal conduct of any third party or images posted by any third party, and you accept sole responsibility for any risk of loss or damage from these causes.
6.3 We do not limit in any way our liability by law to you for death or personal injury caused by our negligence or breach of duty.
6.4 We do not limit or exclude any statutory rights you may have as a consumer.
6.5 We will not be liable to you for any interruption or cessation of transmission to or from minutiae; any viruses, bugs, or similar which may be transmitted to or through minutiae by any third party; any errors or omissions or for any loss or damage incurred as a result of the use of any content made available on minutiae.
6.6 We are not liable for any loss or damage caused by you being unable to view minutiae owing to restrictions imposed by your internet service provider, including firewalls, browsers, networks, and limitations of your equipment.
7. Copyright
7.1 All our intellectual property rights and intellectual property rights relating to minutiae are and remain ours. This includes trademarks, trade names, patents, registered design,s and copyright, including any intellectual property rights derived from the design or functioning of minutiae.
We do not claim ownership of intellectual property rights in images which we use under a licence granted to us under the terms of clause 4.3.
7.2 You agree to respect our intellectual property rights. Except as permitted by these Terms, you will not copy, download, transmit, reproduce, print, or exploit for commercial purposes any Images uploaded to or transmitted by minutiae.
8. Copyright Complaints
8.1 If you see any images on minutiae that you consider is an infringement of any copyright to which you claim to be entitled, please contact us using the Copyright Infringement Notification procedure set out in clause 17 of these Terms.
8.2 We will take reasonable steps to remove copyright material from minutiae where complete and accurate information is supplied in respect of the suggested copyright infringement. You are not entitled to submit a copyright infringement notification where you do not own, or you are not authorized to act on behalf of the owner of the copyrighted material.
9. Indemnity
9.1 You agree to indemnify us and our employees and agents from and against all claims for damages or losses and legal costs arising from:
9.1.1 Your use of and access to minutiae.
9.1.2 Your contravention of any of these Terms.
9.1.3 Your contravention of any rights of third party, including copyright, other intellectual property, or privacy rights.
9.1.4 Any claim we may make that your Images have caused damage to a third party.
10. Third Parties
10.1 Your identity as user of minutiae is invisible, and you remain anonymous to other users of minutiae. The identity of other minutiae users remains anonymous to you.
10.2 minutiae is not linked to or connected with any third-party messaging or chat sites.
11. Termination of Service
11.1 If you wish to terminate your minutiae account and delete personal details from our server, you must email us (info@minutiae-app.org) to request termination
11.2 Once you have requested termination, your account will be rendered inactive within three (3) working days. We will retain your minutiae account details, including your Images, on our servers for six (6) months after account termination. In this period, you can reactivate your account by emailing a request to Support.
12. Work in Progress
Some elements of minutiae are experimental. We cannot promise that minutiae is error-free or that it will always be reliable. If you encounter problems, please tell us about them.
13. Privacy
You acknowledge and agree to be bound by the terms of our Privacy Policy.
14. Events beyond our reasonable control/Invalidity
14.1 We will not be held responsible for any delay or failure to comply with our obligations if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.
14.2 If any part of these Terms is unenforceable (including any provision in which we exclude our liability to you), the enforceability of any other part of these conditions will not be affected.

16. Copyright Infringement Notification
If you see Images transmitted by minutiae that you consider are an infringement of any copyright to which you claim to be entitled in accordance with the Copyrights, Patents, and Designs Act 1988 (as amended) please contact us at the address stated below to notify us of the alleged infringement and in doing so comply with the following requirements. Please supply:
17.1 A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
17.2 Identification of the copyrighted work that you claim has been infringed.
17.3 Definitive identification of the copyrighted material that you claim has been infringed and which you wish to have removed from minutiae. Providing a complete URL in the body of an email is the best way to help us locate such material quickly.
17.4. Full information regarding the person making the complaint including:
i. Name (and company number and place of incorporation if appropriate).
ii. Address.
iii. Telephone and email contact.
iv. A statement that the person making the complaint owns the copyrighted material or is duly authorized to make this complaint on behalf of an identified copyright owner.
